cases to brief: Annette Phillips v. Hooters and Lucy v. Zehmer

This week, you have two cases to brief: Annette Phillips v. Hooters and Lucy v. Zehmer. Each brief should demonstrate your understanding of the cases by answering the following questions:

  1. What are the relevant facts? Relevant facts include all facts that the court relied upon in making its conclusion.
  2. What was the issue or issues the court was considering? What question was the court trying to answer in its decision.
  3. What did the court decide?
  4. Provide a summary of the court’s reasoning. What rationale did the court use in rendering its decision? Your answer should include any rule of law that the court used in coming to its decision.

The link provided below offers further guidance in briefing legal cases and opinions. Please note, however, that for the purposes of this course, your brief does not need to include all the elements of a brief listed in the article. You brief need only include the title of the case, plus the answers to the above four questions.
